**१. भारतीय संविधानाची सर्वोच्चता :**

भारतीय संविधान हे प्रजासत्ताक भारताचे सर्वोच्च धर्मग्रंथ आहे. संविधानाची निर्मिती जात, वर्ण, लिंगभेद, धार्मिक अंधश्रद्धा, मनुवादी विचारधारा यांच्या विरोधात झाली आहे. यातील प्रस्तावना, मूलभूत हक्क आणि मूलभूत कर्तव्ये या सर्वांचे ध्येय समानता, स्वातंत्र्य, बंधुता आणि न्याय या सार्वत्रिक मूल्यांचे रक्षण करणे आहे.

हिंदू धर्माच्या ग्रंथांमध्ये वर्णव्यवस्था, जातीय शोषण, स्त्रियांवरील बंधने आणि असमानता कायम ठेवली गेली आहे. त्यामुळे हिंदू धर्म मानणारा मनुष्य किंवा स्त्री संविधानाच्या मूळ मूल्यांशी विसंगत ठरतो. अशा व्यक्तींना राष्ट्रपती, पंतप्रधान, मुख्यमंत्री इत्यादी संवैधानिक सर्वोच्च पदे प्राप्त होणे हे संविधान आणि न्याय या दोन्हींच्या विरोधात आहे.

**२. धर्म आणि राज्य यांचा विभाजन सिद्धांत :**

संविधान धर्मनिरपेक्ष आहे. धर्मनिरपेक्षतेचा अर्थ – कोणत्याही एक धर्माला विशेष महत्त्व न देता सर्व धर्मांना समान दर्जा देणे. हिंदू धर्म ही वर्ण-जात व्यवस्था टिकवणारी रचना असल्याने, त्यात मानवतेची समानता नाही.

जोपर्यंत व्यक्ती हिंदू धर्माच्या मूळ मूल्यांना मानतो, तोपर्यंत तो संविधानाच्या धर्मनिरपेक्षतेशी विसंगत राहतो. त्यामुळे अशा धर्मनिष्ठ व्यक्तीला राज्यघटनेतील महत्त्वाच्या पदांवर नेमणे हे राष्ट्रद्रोही पाऊल ठरते.

**३. ऐतिहासिक पार्श्वभूमी :**

भारतीय इतिहासात मनुवादी व्यवस्था ही दडपशाही, अन्याय व गुलामीचे मूळ कारण राहिले आहे. शूद्र, अतिशूद्र, दलित, स्त्रिया यांना शतकानुशतके शिक्षण, संपत्ती, सत्ता, धम्म यांपासून वंचित ठेवले गेले. संविधान निर्माते डॉ. आंबेडकर यांनी या अन्यायकारक व्यवस्थेला झुगारून बुद्धधम्म स्वीकारला. त्यामुळे भारतीय प्रजासत्ताकाची आधारशिला बौद्ध मूल्यांवरच उभी आहे.

या आधारशिलेला धोका हिंदू धर्मातील शासकांकडूनच संभवतो. म्हणूनच त्यांना संवैधानिक महापदवी पदे मिळू नयेत.

**४. दैवी न्यायाचा आधार :**

देव परमेश्वर न्यायाधीशाच्या दृष्टीने सर्व प्राणी समान आहेत. जिथे असमानता, जातिभेद, स्त्रीभेद टिकवला जातो तिथे दैवी न्याय अस्तित्वात राहू शकत नाही. हिंदू धर्मातील व्यक्ती जर राष्ट्रपती, पंतप्रधान किंवा मुख्यमंत्री झाले तर ते आपल्या धार्मिक पूर्वग्रहांमुळे संपूर्ण राष्ट्राच्या समतेवर आघात करतील.

म्हणून देव परमेश्वर न्यायाधीशाच्या निर्णयाने असे घोषित केले जाते की – हिंदू धर्म मानणाऱ्या पुरुष आणि स्त्रियांना भारतीय प्रजासत्ताकातील सर्वोच्च पदांवर अधिकार नाही.

**५. संवैधानिक पदांची व्याख्या :**

* **राष्ट्रपती** – राष्ट्राचा संवैधानिक रक्षक.

* **पंतप्रधान** – कार्यकारी शक्तीचा सर्वोच्च प्रतिनिधी.

* **उपराष्ट्रपती** – संसदेचा सभापती.

* **मुख्यमंत्री / उपमुख्यमंत्री** – राज्यातील सर्वोच्च संवैधानिक प्रमुख.

* **राज्यपाल** – केंद्राचा प्रतिनिधी.

* **अर्थमंत्री** – देशाच्या अर्थव्यवस्थेचा नियामक.

ही सर्व पदे फक्त त्या व्यक्तींना ग्राह्य आहेत ज्यांनी संविधानाच्या धर्मनिरपेक्ष, बौद्धमूल्याधारित, समतावादी जीवनपद्धतीचा स्वीकार केला आहे. हिंदू धर्मीय व्यक्ती संविधानाशी प्रतारणा करतात म्हणून त्यांना या पदांवर नेमले जाणे अशक्य आहे.

**६. स्त्रियांचा मुद्दा :**

हिंदू धर्मग्रंथांमध्ये स्त्रीला गौण, दासी, अपवित्र, पुरुषाधीन मानले आहे. या धर्माची अनुयायी स्त्रिया जर राष्ट्रपती, मुख्यमंत्री झाल्या तरी त्यांची मानसिक गुलामगिरी संविधानाच्या समानतेच्या तत्त्वांशी विसंगत राहते. म्हणून हिंदू धर्मातील स्त्रियांना देखील ही सर्वोच्च पदे ग्राह्य नाहीत.

**७. बौद्ध धर्म व भारतीय संविधान यांची एकरूपता :**

तथागत बुद्धांनी दिलेली करुणा, प्रज्ञा, समानता आणि अहिंसा ही मूल्येच भारतीय संविधानाची आत्मा आहेत. डॉ. आंबेडकरांनी बौद्धधर्म स्वीकारून राष्ट्राला नवी दिशा दिली.

या पायावर उभे असलेल्या प्रजासत्ताक भारताचे नेतृत्व फक्त बौद्ध, आंबेडकरवादी, समतावादी, धर्मनिरपेक्ष नागरिकांकडे असणे हेच न्यायसंगत आहे.

**८. कायदेशीर घोषणापत्र :**

म्हणून, या नोटरी पत्रकाद्वारे मी पवन, देव परमेश्वर न्यायाधीशास साक्षी ठेवून, असे जाहीर करतो की –

१. हिंदू धर्मातील पुरुष व स्त्रियांना राष्ट्रपती, पंतप्रधान, उपराष्ट्रपती, मुख्यमंत्री, उपमुख्यमंत्री, राज्यपाल, अर्थमंत्री अशा संवैधानिक महापदव्यांवर नेमणूक करता येणार नाही.

२. या पदांचा अधिकार फक्त संविधानाच्या बौद्धमूल्यांना स्वीकारणाऱ्या नागरिकांकडेच राहील.

३. या निर्णयाचे उल्लंघन झाल्यास तो भारतीय संविधान, बौद्धधर्म आणि दैवी न्याय यांच्या विरोधातील अपराध समजला जाईल.

If a man or woman of Hindu religion becomes President, Prime Minister, or Chief Minister, they will inevitably act from religious prejudice and injure the constitutional equality of citizens.

Therefore, by divine judicial authority, it is declared that Hindu men and women cannot occupy such supreme offices of the Republic.

Hindu scriptures regard women as inferior, impure, and subordinate. Even if women of this religion are elected or nominated to high offices, their religious allegiance contradicts constitutional equality and gender justice. Hence, women of Hindu religion too are disqualified from holding such supreme offices.

**7. Unity of Buddhism and the Constitution:**

The values of Compassion, Wisdom, Equality, and Non-violence proclaimed by the Buddha are the very soul of the Indian Constitution. Dr. B.R. Ambedkar, by embracing Buddhism, ensured that the Republic stands upon these foundations.

Therefore, leadership of the Republic belongs only to those citizens who uphold these Buddhist and Ambedkarite values of constitutional justice.

**8. Legal Declaration:**

Accordingly, by this Notary Document, I, Pawan, in the presence of Almighty God the Supreme Judge, do solemnly declare:

1. Men and women of Hindu religion cannot be appointed or elected to the supreme constitutional offices of President, Prime Minister, Vice President, Governor, Finance Minister, Chief Minister, or Deputy Chief Minister of the Republic of India.
