(Image on Currency Notes)
-
-
Union List Entry 36 : "Currency, coinage and legal tender"
-
Union List Entry 37 : "Foreign exchange"
(RBI Act, 1934)

Divine Judicial Notary Document
Subject: Constitutional provisions of the Indian Constitution regarding currency, authority of the Union Government, and the legal possibility of replacing the portrait of Mahatma Gandhi on Indian currency with that of Bodhisattva Dr. B.R. Ambedkar – a detailed explanation
Preamble
This document is presented within the framework of the Indian Constitution, founded upon the supreme values of justice, equality, and fraternity, and concerns itself with the highest symbol of the nation’s economy and sovereignty – the Indian currency. At present, the portrait of Mahatma Gandhi is imprinted on Indian banknotes. However, this is not a constitutional mandate, but merely a policy decision adopted by the Government of India. Therefore, if the Union Government, in consultation with the Reserve Bank of India, resolves to do so, it is legally and constitutionally possible to replace Gandhi’s portrait with that of the Bodhisattva, Dr. B.R. Ambedkar, the architect of the Indian Constitution.
1) Constitutional Provisions
The Indian Constitution does not specify whose portrait must appear on the currency. However, matters relating to currency fall under the Union List of the Seventh Schedule.
-
Article 246: Grants the Union Government exclusive authority to legislate on matters in the Union List.
-
Union List Entry 36: Includes “currency, coinage and legal tender.”
-
Union List Entry 37: Covers “foreign exchange.”
Thus, the authority to print, design, and alter currency is vested solely in the Union Government and the Reserve Bank of India under its supervision.
2) The Reserve Bank of India Act, 1934
The Reserve Bank of India (RBI) is entrusted with the responsibility of printing banknotes.
-
Under the RBI Act, the design, portrait, and textual details of currency are determined by the RBI with the approval of the Central Government.
-
Declaring a note as “legal tender” is the prerogative of the Government of India.
-
The practice of featuring Gandhi’s portrait is therefore an administrative convention, not a constitutional requirement.
3) Position of Mahatma Gandhi’s Portrait
The decision to feature Mahatma Gandhi’s image on Indian banknotes was introduced in 1996. Before this period, Indian notes carried images of lions, the Ashoka Pillar, and other cultural or natural symbols.
👉 This confirms that Gandhi’s portrait is not constitutionally mandatory but a policy choice.
4) Historical Contribution of Bodhisattva Dr. B.R. Ambedkar
Dr. B.R. Ambedkar is revered as the principal architect of the Indian Constitution, a social reformer, an economic thinker, and the Bodhisattva who revived Buddhism in India.
-
Constitutional Contribution: He gave India its democratic, secular, and egalitarian framework.
-
Economic Vision: His insights on central banking, agriculture, and industrial development shaped India’s policies.
-
Social Justice: As the leader of the oppressed and marginalized, he symbolized hope, dignity, and equality.
Printing his portrait on Indian currency is not only an act of national honor but also a reinforcement of constitutional values of justice, equality, and fraternity.
5) Constitutionally Consistent Procedure
If the Government decides to replace Gandhi’s image with Ambedkar’s, the following constitutional process would apply:
-
Union Cabinet Approval – The Ministry of Finance and the Cabinet take the policy decision.
-
Consultation with RBI – Designs are prepared and approved.
-
Issuance of New Currency – New notes are gradually introduced into circulation.
-
Phasing Out Old Notes – Older notes continue temporarily before being withdrawn.
This process is fully legal and constitutional.
6) Judicial Perspective
In judicial terms, since there is no constitutional clause requiring Gandhi’s portrait on currency, replacing it with Ambedkar’s portrait would not be unconstitutional. On the contrary, such a step would reflect the core principles of the Constitution—justice, equality, fraternity, and liberty.
7) Social and National Impact
-
Fraternity in Society: The oppressed and marginalized would feel represented and dignified.
-
Constitutional Awareness: Every citizen handling currency would be reminded of the constitutional ideals framed by its creator.
-
National Identity: Internationally, India would be seen as a nation honoring not just political icons, but also the values of social justice and constitutional morality.
8) Conclusion
By virtue of Article 246 and Union List Entries 36 and 37 of the Indian Constitution, matters of currency fall exclusively under the Union Government. Featuring Gandhi’s portrait was never a constitutional mandate, but an administrative decision. Therefore, if the Union Government resolves to do so, issuing currency notes bearing the portrait of Bodhisattva Dr. B.R. Ambedkar would be entirely legal, constitutional, and historically justified.
✍️ Thus, this detailed judicial notary-style statement affirms the constitutional possibility and moral necessity of placing Dr. B.R. Ambedkar’s portrait on Indian currency in place of Mahatma Gandhi’s.
