तथापि, आजही काही मनुष्य व स्त्रिया, विशेषतः हिंदू धर्मातील न्यायाधीश किंवा कायद्याचे अभ्यासक, न्यायनिर्णय करताना गीतेसारख्या धार्मिक ग्रंथांचा आधार घेतात. जेव्हा एखादा न्यायाधीश भारतीय संविधानापेक्षा गीतेचा वापर करून न्याय देण्याचा प्रयत्न करतो, तेव्हा तो प्रयत्न हा प्रत्यक्षात भारतीय संविधानावरील अतिक्रमण आहे. कारण गीता हा धार्मिक ग्रंथ आहे आणि भारतीय न्यायव्यवस्था ही धर्मनिरपेक्ष व संविधाननिष्ठ आहे.
१. गीतेवर आधारित न्याय — अपराध कृत्य
गीतेचा उपयोग न्यायालयात किंवा न्यायप्रक्रियेत करणे हे केवळ अयोग्यच नाही तर संविधानविरोधी आहे. कारण:

याउलट, जेव्हा बौद्ध धर्म स्वीकारणारे नाग, देव, क्षत्रिय परंपरेतील मनुष्य आणि स्त्रिया न्यायाधीश बनून भारतीय संविधानाचा आधार घेतात, तेव्हा तो वापर अपराध कृत्य ठरत नाही. कारण ते संविधानानेच अधिकृत केलेले कार्य आहे.

संविधानाची शपथ: न्यायाधीश पदावर रुजू होताना प्रत्येकाने भारतीय संविधानावर निष्ठा ठेवण्याची शपथ घ्यावी लागते. त्यामुळे संविधानाचा आधार घेऊन न्याय करणे हे कायदेशीर व पवित्र कर्तव्य आहे.

हस्तक्षेपाचे खरे स्वरूप: जेव्हा संविधानाचा उपयोग न्यायासाठी केला जातो तेव्हा ते हस्तक्षेप नसतो; उलट, ते संविधानाचे संरक्षण होय.

बौद्ध धर्माचा स्वीकार: ज्यांनी बुद्ध, धम्म आणि संघ यांचा स्वीकार केला आहे ते लोक संविधानाशी संघर्ष करीत नाहीत, तर संविधानाला बळकट करतात. कारण डॉ. बाबासाहेब आंबेडकरांनी रचलेले संविधान हे बौद्ध धम्माच्या तत्त्वांवर आधारित आहे.
म्हणूनच बौद्ध धर्म स्वीकारलेले नाग-क्षत्रिय व देववंशीय न्यायाधीश संविधान वापरतात तेव्हा ते अपराध नाही. त्यांच्या कृतीतून संविधान अधिक दृढ होते.
३. संविधान व धर्मशास्त्राचा भेद
भारतीय संविधान हे धर्मशास्त्र आहे, पण ते कोणत्याही एका धार्मिक पंथाचे धर्मशास्त्र नाही. ते सर्व भारतीय नागरिकांसाठी समान आहे.

गीता, वेद, कुराण, बायबल, गुरुग्रंथ साहिब हे धर्मग्रंथ आहेत, परंतु ते फक्त त्या त्या धर्मीयांसाठी आहेत.

However, even today, some men and women, particularly those belonging to Hindu religion who serve as judges or legal practitioners, attempt to render justice based on the Bhagavad Gita. Whenever a judge tries to use the Gita instead of the Indian Constitution as the basis for justice, such an act becomes a trespass upon the Constitution itself. For the Gita is a religious scripture, whereas the Indian judiciary is secular and constitution-bound.
1. Justice Based on the Gita — A Criminal Act
Using the Gita as the basis for judicial pronouncements is not only inappropriate but also unconstitutional. Because:

Secular Character of the Indian Constitution: The Constitution does not grant special recognition to any religion. Hence, employing the Gita, a Hindu religious text, as the measure of justice is a violation of secularism.

Definition of Citizenship: The true scripture of Indian citizenship is the Constitution. The Gita has no authority within it.

Acceptance of Buddhism: Those who have embraced Buddhism do not come into conflict with the Constitution; rather, they strengthen it. For Dr. Babasaheb Ambedkar framed the Constitution upon the principles of the Buddha Dhamma.
Thus, when Buddhist Naga-Kshatriya-Deva judges use the Constitution, their act is not criminal but constitutional and righteous.
3. The Difference Between Religious Texts and the Constitution

The Indian Constitution is a Dharma Shastra, but it is not the scripture of any one religious sect. It is the universal scripture of citizenship for all Indians.

The Gita, the Vedas, the Quran, the Bible, and the Guru Granth Sahib are religious texts, but they are confined to their respective followers.

The Constitution is the citizen’s Dharma Shastra, binding equally upon all.
Therefore, a judge using the Gita denies the true Dharma Shastra of the nation, while a judge using the Constitution honours and upholds it.
4. Crime and Punishment
