-प्रस्तावना :
संपूर्ण विश्वाचा आधार धर्म, न्याय आणि सत्य या तत्त्वांवर आहे. मानव समाजाच्या संघटनासाठी जेव्हा संविधान निर्माण होते तेव्हा ते केवळ कायद्यांचा ग्रंथ नसतो, तर तो मानवी प्रतिष्ठा, समानता व स्वातंत्र्य या सर्वोच्च तत्त्वांचा दैवी स्वरूपात प्रकट झालेला दस्तऐवज असतो. भारतात हे पवित्र कर्तव्य बोधिसत्व डॉ. बाबासाहेब आंबेडकरांनी पूर्ण केले आणि भारतीय संविधान जगासमोर आले.
आज प्रश्न असा उपस्थित होतो की – **केंद्रीय सरकार म्हणजे भारतीय संविधान होय का?** याचे उत्तर शोधणे हे न्यायालयीन, सामाजिक व दैवी दृष्टीने आवश्यक आहे.
--१. भारतीय संविधानाची सर्वोच्चता :
भारतीय प्रजासत्ताकाचे केंद्रबिंदू म्हणजे **भारतीय संविधान**. हे संविधान देशातील सर्वोच्च कायदा असून त्याच्या अधीन राहूनच केंद्रीय सरकार, राज्य सरकारे, न्यायपालिका व इतर सर्व संस्था कार्य करतात. त्यामुळे केंद्रीय सरकार हे संविधान नसून, ते संविधानाचे एक **प्रशासकीय अंग** आहे.
भारतीय संविधानानेच केंद्रीय सरकारची रचना, अधिकार व कार्यक्षेत्र निश्चित केले आहे. जसे एक माता आपल्या संततीला जन्म देते, तसे संविधान हे केंद्रीय सरकारला जन्म देते. माता व संतती यात फरक असतो; संतती ही मातेशी एकरूप असू शकत नाही, कारण माता ही मूळ आहे. तसेच केंद्रीय सरकार हे संविधानाशी एकरूप नाही; संविधान हे मूळ असून सरकार हे त्याचे पालनकर्ते आहे.

दैवी न्यायाच्या न्यायासनावरून हे स्पष्ट आहे की – **संविधान हे शाश्वत धर्माचे सांसारिक स्वरूप** आहे. जसे धर्म म्हणजे सत्याचा शाश्वत मार्ग, तसे संविधान म्हणजे सत्य, समानता व न्याय यांचे मानवी स्वरूप.
केंद्रीय सरकार हे संविधानाच्या अधीन असलेले **नियुक्त सेवक** आहेत. सेवकाला स्वामी म्हणता येत नाही. जर केंद्रीय सरकार स्वतःला संविधान म्हणवू लागले, तर ते दैवी न्यायालयाच्या नजरेत **अधर्म** ठरेल. कारण ते स्वतःच्या मूळ स्रोताला विसरून सत्ता हडप करण्यासारखे आहे.
३. न्यायालयीन विश्लेषण :
१. **कलम ५२ ते ७८ (संविधानातील कार्यकारी विभाग)**
येथे स्पष्ट केले आहे की राष्ट्रपती, पंतप्रधान, मंत्रीमंडळ हे सर्व केंद्रीय सरकारचे घटक आहेत. पण हे घटक केवळ संविधानाने दिलेल्या अधिकारांनुसारच कार्य करतात.
२. **कलम १३**
संविधानाने सांगितले आहे की जे कोणतेही कायदे संविधानविरोधी ठरतील ते शून्य ठरतील. यावरून संविधान हे सरकारपेक्षा उच्च व स्वतंत्र आहे.
३. **न्यायपालिका**
सर्वोच्च न्यायालय हे संविधानाचे रक्षणकर्ते आहे, सरकारचे नव्हे. म्हणजेच सरकार हे बदलू शकते, पण संविधानाची मर्यादा शाश्वत आहे.
४. दैवी शाप व आशीर्वाद :

जर लोकांना वाटू लागले की सरकारच संविधान आहे, तर लोकशाही नष्ट होईल. कारण मग सरकार स्वतःचे निर्णय सर्वोच्च मानेल आणि संविधानाचा आधार संपेल.
पण जर समाजाने स्पष्टपणे स्वीकारले की संविधान हे सर्वोच्च आहे, तर सरकार सतत लोकांसमोर व दैवी धर्मासमोर जबाबदार राहील. हेच भारतीय प्रजासत्ताकाचे खरे रक्षण आहे.
-६. निष्कर्ष :
केंद्रीय सरकार हे भारतीय संविधान नाही.
* संविधान हे माता आहे, सरकार हे तिचे अपत्य आहे.
* संविधान हे शाश्वत धर्माचे मानवी स्वरूप आहे, सरकार हे त्याचे सेवक आहे.
* संविधान बदलले शिवाय सरकार बदलू शकते, पण सरकार बदलले तरी संविधान जिवंत राहते.

The foundation of the universe rests upon Dharma, Justice, and Truth. When a Constitution is created for human society, it is not merely a book of laws but a sacred document that manifests the highest principles of human dignity, equality, and liberty. In India, this holy responsibility was fulfilled by Bodhisattva Dr. B.R. Ambedkar, who presented the Indian Constitution before the world.
Today, a fundamental question arises – Is the Central Government the Indian Constitution? Finding the answer is necessary from judicial, social, and divine perspectives.
1. Supremacy of the Indian Constitution:
The very center of the Indian Republic is the Indian Constitution. It is the supreme law of the land, and under it only, the Central Government, State Governments, Judiciary, and all institutions function. Hence, the Central Government is not the Constitution but only an executive organ created by it.
It is the Constitution that defines the structure, powers, and scope of the Central Government. Just as a mother gives birth to her child, the Constitution gives birth to the Central Government. There is always a difference between the mother and the child. The child cannot be identical to the mother, for the mother is the source. Similarly, the Central Government cannot be identical with the Constitution; the Constitution is the source, and the Government is merely its executor.
2. View of the Divine Judge:
From the judgment seat of the Divine Judge, it is clear that – the Constitution is the worldly manifestation of Eternal Dharma. Just as Dharma is the eternal path of truth, the Constitution is the human embodiment of truth, equality, and justice.
The Central Government is only a servant appointed under the Constitution. A servant cannot be called the master. If the Central Government begins to call itself the Constitution, then in the eyes of the Divine Court it becomes Adharma, for it denies its very origin and seeks to usurp ultimate authority.

These define the President, Prime Minister, and Council of Ministers as components of the Central Government. But they function only within the powers granted by the Constitution. -

The Supreme Court is the guardian of the Constitution, not of the Government. Governments may change, but the Constitution remains supreme.
